These Terms of Service (“Terms”) govern your use of the Shipr platform at shipr.club (“the Service”), operated by Shipr (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
Shipr is an AI-powered platform that helps you plan, build, and deploy web applications. The Service includes AI-assisted project planning (discovery, requirements, UX research, UX design, scope confirmation, and technical specification), code generation, and deployment integrations.
2. Eligibility
You must be at least 16 years old to use Shipr. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account Responsibilities
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorised access to your account.
- You may not share your account or allow others to access the Service through your account.
4. Acceptable Use
You agree not to use Shipr to:
- Generate applications that are illegal, harmful, or violate the rights of others.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary systems.
- Circumvent rate limits, usage quotas, or access controls.
- Use automated tools to scrape, crawl, or overload the Service.
- Impersonate another person or misrepresent your identity.
- Generate malware, phishing pages, or applications designed to exploit or deceive users.
5. Intellectual Property
Your content: You retain full ownership of the ideas, project plans, and generated code created using Shipr. You are free to use, modify, distribute, and commercialise your generated output without restriction.
Our platform: We retain ownership of the Shipr platform, its design, features, branding, and underlying technology. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service.
6. AI-Generated Output
Shipr uses AI models to generate project plans and code. While we strive for high quality, AI-generated output may contain errors, bugs, or security vulnerabilities. You are responsible for reviewing, testing, and validating any generated code before deploying it to production. We do not guarantee that generated code is free of defects.
7. Third-Party Integrations
The Service integrates with third-party platforms (GitHub, Vercel, Supabase, Stripe). Your use of these integrations is subject to those platforms' own terms of service. We are not responsible for the availability, performance, or policies of third-party services.
8. Subscriptions and Billing
- Some features of Shipr require a paid subscription (Pro plan).
- Subscriptions are billed monthly or annually via Stripe.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We do not offer refunds for partial billing periods, except where required by applicable law.
- We reserve the right to change pricing with 30 days' notice.
9. Service Availability
We aim to provide reliable uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.
10. Termination
We may suspend or terminate your access to Shipr if you violate these Terms, engage in abusive behaviour, or for any other reason at our reasonable discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.
11. Limitation of Liability
To the maximum extent permitted by law, Shipr and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through a notice on the platform. Continued use of Shipr after changes constitutes acceptance of the updated Terms.
